Terms and Conditions for the Advertiser

1. General
1.1 If you have chosen to advertise your properties on our website then you accept and agree to be bound by our terms and conditions which may be updated by us from time to time.
1.2 You understand and expressly agree that your use of our services is at your sole risk, that any material and/or data downloaded or otherwise obtained through the use of our services is at your own discretion and risk and that you will be solely responsible for any damage to your computer system or loss of data that results from the download of such material and/or data.
1.3 We aim to make our site available continually but we do not warrant that it will be available 24 hours a day, or that it will be free from interruptions, errors or viruses or other harmful components.
2. Web design and layout
2.1 havensandhideaways.com reserves the right to determine the final design layout and functionality of this site and to edit, copy or amend the layouts and photographs that you supply
2.2 We shall not be held responsible for any loss or damage resulting from the design or positioning of the properties or changes to photographs
3. Accuracy
3.1 We do not accept any responsibility whatsoever for the accuracy of your advertisements or for any claims by the users of our site for any breach by you
3.2 Advertisers are responsible for keeping the details of their property advertisements accurate and up to date, in particular where special offers are being displayed.
3.3 If required, we shall endeavour to return to you the information and/or materials which you provide to us, but we shall not be responsible for any loss or damage caused to such information and/or materials
4. Your Account
4.1 Before you are given access to our site to set up your advertisement you are required to apply for an account with us and to pay our subscription fees from time to time. Once you have access to our site you shall be required to set up a password to enable you to access your advert and amend it as you require.
4.2 You are responsible for maintaining the confidentiality of your password and the details of your advert. You are responsible for all uses of your advert, whether or not actually or expressly authorised by you.
4.3 We may modify or discontinue our services or your account with us, with or without notice, without liability to you, any other user or any third party. We reserve the right to terminate your account if we learn that you have provided us with false or misleading information, interfered with other users or the administration of havensandhideaways.com services, entered or attempted to enter unsuitable material onto our website or violated these terms and conditions.
4.4 We assume no responsibility for the timeliness, deletion, misdelivery or failure to store any user communications or personalisation settings. In particular, but not by way of limitation, we may delete e-mail accounts or the information therein if the account is inactive for greater than ninety (90) days.
4.5 It is the advertisers responsibility to obtain reproduction permission for all photographic and other material used in their advertisements. The advertiser warrants that he is the owner of the copyright in such material or is authorised by the owner thereof to grant to havensandhideaways.com the rights contained therein. The advertiser shall indemnify havensandhideaways.com against any action brought for breach of copyright from the use of such material supplied by the advertiser.
5. Termination of Advertising
5.1 If advertisers wish to have their advertisement removed from the internet before the end of their subscription period then you should notify havensandhideaways.com in writing but no refunds will be paid
5.2 havensandhideaways.com reserves the right to refuse to display any advertisement on their website without any liability whatsoever
5.3 If havensandhideaways.com receives substantiated complaints from a person who has rented an advertisers property, or if a property has been double booked, or if the advertiser engages in unacceptable practices, then we reserve the right to remove the advert from our website without notice
6. Disclaimer of Warranty
Except as expressly provided on our site, we disclaim all warranties of any kind, express or implied, including without limitation any warranty of merchantability, fitness for a particular purpose or non-infringement and we make no warranty or representation regarding the results that may be obtained from the use of our services, regarding the accuracy or reliability of any information obtained through our services, regarding any goods or services purchased or obtained through our services, regarding any transactions entered into through our services or that our services will meet any users requirements, be uninterrupted, timely, secure or error free.
7. Limitation of Liability
havensandhideaways.com will not be liable to the advertiser for any direct, indirect, incidental, special, consequential or punitive damages of any kind resulting from the use of or the inability to use our services, resulting from any goods or services purchased or obtained or messages received or transactions entered into through our services, resulting from the loss of unauthorised access to or alteration of a users transmissions or data or for the cost of procurement of substitute goods and services, including but not limited to damages for loss of profits, use, data or other intangibles, even if we had been advised of the possibility of such damages.
8. Indemnity
You agree to indemnify, defend and hold harmless havensandhideaways.com, its affiliates, officers, directors, employees, consultants and agents from any and all third party claims, liability damages and/or costs (including, but not limited to, legal costs) arising from your use of our services, your violation of these terms and conditions or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity. These terms and conditions will inure to the benefit of havensandhideaways.com successors, assigns and licensees.
9. Changes to Site
havensandhideaways.com may at any time without notice make improvements or changes in information format, types of services and products provided, and other materials on this site, including termination of this site. havensandhideaways.com reserves the right to amend these terms and conditions at any time and such amendments shall be effective immediately upon posting of the amended agreement on the site. Your continued use of this site shall constitute your acceptance and agreement to any amendments that may be made.
10. Jurisdiction and Law
These terms and conditions shall be governed by and construed in accordance with the Laws of England and Wales and all disputes arising out of them shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales.
